About Michael & Associates

Michael & Associates gives you our white glove treatment, and the best defense possible.

There are a hundred firms out there that will charge you less money and promise you the moon. The problem is when you have questions, will they be there to answer them? Will larger firms really give you the best chance for success? Most likely, they see you as simply a case to close. Those large firms really do just churn cases as quickly as possible

Michael & Associates takes on a limited number of cases each week so that we can treat each case differently.

A unique defense for a unique situation. It seems simple, but they just don't do it.

You will be given Ben Michael's personal cell phone number and you can call him anytime, morning or evening. At the other firms, you'd be lucky to get a secretary who takes a message and calls you back a week later

Ben will take the time to walk through each step of your case to make sure you understand the situation. He understands that this is a gut-wrenching time for you, and his goal is to get the best possible outcome, using the best defense, and make this as smooth as possible for you.

Michael & Associates will accept misdemeanor and felony criminal cases of all types. We specialize in criminal case like:

Driving While Intoxicated in Seguin

In Seguin, Guadalupe County, and throughout Texas, drivers caught with a blood alcohol content (BAC) of 0.08% or risk being arrested for DWI.  That number is a measure of what percent of your bloodstream contains alcohol.

Things like height, weight and sex all factor into your tolerance when it comes to BAC. The main factor will be how long it has been since you had your last alcoholic beverage.

In Seguin, like elsewhere in TX, the punishment will depend on your prior arrests.

1st Offense

  • As much as a $2,000 fine
  • As much as six months in jail with a 3-day mandatory minimum
  • Losing your license for as much as a year

2nd Offense

  • As much as a $4,000 fine
  • From 1 to 12 months in jail
  • Losing your license for as much as two years

3rd Offense

  • A $10,000 fine
  • 2 to 10 years in prison
  • Losing your license for as much as two years

Sentencing guidelines call for enhancements if minors are in the vehicle:

  • Increased fines up to $10,000
  • As much as 2 years in jail
  • 180 more days of license suspension

The first thing to remember is that running from the police will only make your situation worse. Pull over immediately and be as respectful as possible. Remember that you are probably being filmed on a bodycam.

The officer will approach your window and they will ask for your license, registration, and proof of insurance.  Be sure to let the officer know where you will be reaching for the documents.

police will ask if you are aware of the reason for the traffic stop.  Respectfully say, "No Sir" or "No Ma'am".  The officer is looking to establish probable cause. You don't want to eliminate a potential avenue of defense for your lawyer to pursue on your behalf.

It's within your Constitutional rights to decline participation in both a field sobriety test and a preliminary breathalyzer test.  If you may fail either one, it is wise to refuse these.  Respectfully say you want to speak with your attorney before participating in any tests.  Remember to be as polite and non-aggressive as possible.

You could still be arrested for suspicion of DWI if the police find you have slurred speech, alcohol smell, or bloodshot eyes.  If that happens you could be asked to take a blood or breath test to establish BAC.  Refusal means you face automatic DL suspension, but if you are convicted you will have your license suspended anyway.  In both situations, a lawyer can help you fight the charges.

The police can request a warrant from a judge to compel you to take the test, but this can take some time.

Never speak to police during questioning without your lawyer present, and contact your lawyer at the first chance you have.

Remember that you should never plead guilty when charged with a DUI.  If it is a client's first or third DUI, we can almost always get a reduction or dismissal of charges if you fight the charges.
