Driving While Intoxicated in Round Rock

In Round Rock, Williamson County, and anywhere else in Texas, anyone with a blood alcohol content (BAC) of 0.08% or higher can be arrested for DWI. That measurement of alcohol in your bloodstream is the line between release and arrest.

Depending on several key factors, you might mistakenly have a BAC higher than you thought you would. Things such as the amount of time since your last drink and the amount of alcohol in the drink will affect your BAC. Your sex, height, and weight also play a role.

In Round Rock, the penalties vary based on how many offenses you have had.

1st Offense: 

  • Up to a $2000 fine

Never run from an officer. It will only increase the penalties you face.

Always be calm, and never make sudden movements. Comply with the officer's request for your documents. Tell the officer you are reaching for them before you do so.

Never admit you know why you were pulled over. Respectfully say you don't know.  You don't want to admit there was a valid reason for the stop. You want to preserve that option for your court date, should it come to that.

If you are asked to take the breathalyzer test, or step out of the car and take a field sobriety test, you have the right to say no. If you think you might fail, it's a good idea to refuse. Respectfully state that you don't feel comfortable taking the tests, and ask to speak with an attorney before consenting to any tests. Stay calm and respectful, remember you are probably on video.

You may get arrested at the officer's discretion for slurred speech or the odor of alcohol. If you are arrested, you will be asked to take the tests again. Refusal means you will lose your license. That said, if you are convicted of DUI you will lose your license anyway. Your lawyer will help you contest the loss of the license and the DWI charge.

You may be subjected to a blood test after a warrant is issued, but that warrant will take some time to get.

Never speak without your attorney present, and call your attorney at the first opportunity.

You should always fight any DWI charge. Whether this is your first one or your third one, the stakes are too high to simply accept the DWI.
