Driving While Intoxicated in Manchaca

In Manchaca, Travis County, and all of Texas, Your intoxication level is measured by the amount of alcohol in your bloodstream, called your BAC. Anything over .08% is over the legal limit.

That limit is a hard line you can't be at or over. Your age, height, weight, and sex will all be contributing factors. The biggest factor will be how long it has been since you stopped drinking.

You can't outrun the police, or your charges, so stop immediately and be respectful to the officer. 

Once they walk up to your window, greet them with a warm greeting and answer their request for paperwork with a polite yes. 

If you are asked if you know the reason for the stop, the officer is looking to establish probable cause. Be sure to say that you don't know why, but remain non-aggressive. You don't want to incriminate yourself. 

You have the right to refuse any test you are asked to participate in, but do so respectfully. Just tell the officer you would prefer to talk to a lawyer before participating in a test. 

If the police think they detect slurred speech, alcohol smell, or bloodshot eyes, you will be detained on suspicion of DWI.  They will ask you again to take a test. Refusal to take the test is a mandatory license suspension. You will have it suspended if you fail the test anyway. A lawyer can help you fight either situation.

They can get a warrant to force a blood draw, but it will take them some time.

Never incriminate yourself during questioning by police, and ask to see your lawyer at the earliest chance.
