Driving While Intoxicated in Irving

In Irving,  Dallas County, or anywhere else in Texas, a BAC of 0.08% or higher indicates DWI.  BAC is a measure of the alcohol saturation in your bloodstream.

A few different things will go into figuring out your BAC. Your height, weight, and overall size are the key factor. Sex is another factor. Tolerance and time passed since you last drank round out the criteria. 

In Irving, the penalties vary based on how many offenses you have had.

1st Offense

  • As high as a $2,000 fine
  • As many as six months in jail, with three mandatory days in jail
  • A year's suspension of your license

2nd Offense

  • AS long as a year in jail

The obvious first thing to remember is to pull over right away when you see the lights. Never flee from police since that is a felony with extremely harsh jail sentences attached. 

The officer will then come to your window and ask you to show your license and registration. Be sure to ask for permission to reach for them before you do so. Afterward, go slowly and don't make aggressive movements or remarks. You are likely on body cam, so ensure you are as respectful as possible. 

Always remember that an officer asks if you know why you were stopped so they can establish the probable cause for the stop. Just politely reply, "No Sir" or "No Ma'am."  In court, the question will come up. Don't remove a vector of defense for your legal team. 

It's not a bad idea to refuse the tests that the officer requests you undergo if you feel you won't pass the test anyway. Simply say that you would like to speak with your lawyer before taking any exam, and remember to remain polite and calm.  

If the offer suspects you of slurring your words or smelling like liquor, they might make an arrest for suspicion of DWI.  If you are arrested, The officer will try to establish a record of your BAC.  If you refuse the exams, you will lose your license for a year. You will lose your DL if you are convicted though. A lawyer will help you navigate the process from here. 

They can get a warrant to draw blood, but it takes time to transport you to the station and get the warrant. 

Never answer anything that can incriminate you. Always ask to speak with your attorney at the earliest opportunity.
