Michael & Associates brings two big things to the table: the best service in town and a win record that speaks for itself.

Any local firm can offer you cheaper rates, but their performance and service isn't worth a $10 bill. You'll get stuck dealing with an uninterested secretary or office manager who will take days to return your call, because you're one of tens or hundreds of clients they're serving at the same time.

With Michael & Associates, we only bite off what we can chew - we take only the amount of clients that we can handle with our full effort and undivided attention.

We take pride in our work and hold ourselves to a high standard. This is why you get access to Ben Michael's personal cell phone number. You can text him day or night, and he'll walk you through the entire DWI process from start to finish. He doesn't want to just help you win, he wants you to feel at ease with us.

Then, of course, you get our stellar performance in the courtroom. We have a high win record, because we've been doing this for a while.

For Dentonites, Michael & Associates takes on the following misdemeanors and felonies:

Driving While Intoxicated in Denton

In Denton, Denton County, and all of Texas, you can be charged with a DWI if your blood alcohol content is higher than the legal limit.

The limit isn't based on how many drinks a person has had or whether or not they were even driving well. You could be the perfect driver even at the legal limit but still face consequences if caught.

The limit is 0.08% or higher. This means that your blood is made up of 0.08% alcohol at the time of your breathalyzer or blood test. This number is picked as this is when most people show enough impairment from their drinking to make them a possible danger behind the wheel.

In Denton, your charges differ depending on the circumstances of your arrest and how many previous DWI convictions you've had.

For Your First Offense:

  • Up to a $2,000 fine from the court system
  • Up to 180 jails upon conviction, with three mandatory days in jail
  • Loss of driver's license for up to a year

For Your Second Offense:

  • Up to a $4,000 fine from the court system
  • One month to a year in jail
  • Loss of driver's license for up to two years

For Your Third Offense

  • A $10,000 fine from the court system
  • Two to ten years in prison, not jail
  • Loss of driver's license up to two years

As mentioned above, your penalties depend on the circumstances of the arrest. If you were caught with a child in the car, for example, you can face:

  • Additional fines up to $10,000
  • Up to two years in jail
  • Additional 180 days of driver's license suspension

If you see the flashing red and blue lights behind you, don't try to flee - this isn't a Vin Diesel film. You have to obey the law or suffer worse consequences. Pull over to the side of the road or somewhere else that is safe as soon as you can do so in a cautious manner.

The police officer who pulled you over will come to your window and request your documents. Let him or her know where they are in your car before fetching them.

If you're suspected of driving drunk, you will be asked to take a breathalyzer or a field sobriety test. If you have any doubts about your sobriety and fear you may be over the limit, you can politely refuse them. Inform the officer that you would rather wait until you got in touch with your attorney before taking them.

The officer might arrest you if you're showing any obvious signs of intoxication. This is a bit more serious than just being let go, but have no fear, as there are still ways to fight any possible charges that occur.

Before they charge you, they might want to get you to take a test. At this point, you'll be offered a breathalyzer again or a blood test to find out what your BAC is. You can refuse these tests at the cost of your license being suspended. If you take the tests, though, you can still have it suspended if you fail.

The only test you will have to take for sure is one with a warrant. This doesn't always happen due to time constraints, but if it does, you must comply.

No matter how good or bad things go, remember that your lawyer will defend you. Be sure to be as polite as possible when dealing with the officers as you may be recorded and, even if not, being polite will only help you with your day in court. You also need to be silent when questioned, particularly if you're asked about why you were pulled over. Wait until you have access to your lawyer for advice on what to do or say.

Never plead guilty or go in without putting up a fight. A lawyer might seem expensive at first, but if you're facing $2,000 or $10,000 fines, you'll be happy you hired one when you only have to pay their fees due to your case getting dismissed.
