Were You Stopped for DWI in Copperas Cove?

It's terrifying to be arrested for DWI. We know.

Defined as having a BAC at or above .08%, a DWI is one of the most common offenses residents of Copperas Cove are arrested for.

Unfortunately, Texas and the Coryell County prosecutor don't look kindly upon DWI offenders, and the punishments are severe. That's where Michael & Associates comes in.

A DWI is Expensive and Stressful

Just because it's a common offense, you might assume DWI charges carry light sentences.

Guess again.

The guidelines for sentencing are as follows:

First Offense:

  • As high as a $2000 fine
  • Between 3 days and 6 months in jail
  • Suspension of your license for up to a year

Second Offense:

  • As high as a $2000 fine
  • From one to twelve months in jail
  • Suspension of your license for as many as two years

Third Offense:

  • As high as a $10,000 fine
  • From two to ten years in prison
  • Suspension of your license for as many as two years
  • Felony record

That doesn't even count any enhanced penalties, such as driving with a minor passenger.

Don't Take a Chance With Your Future

Other downsides to a conviction include the suspension of your license, it becomes harder to find a job, and there is a spike in your insurance rates.

The stakes are as high as can be, so you owe it to yourself to get the best attorney available.

When you are arrested for DWI, hiring an experienced lawyer is vital. Contact the team at Michael & Associates today.

Driving While Intoxicated in Copperas Cove

In Copperas Cove, Coryell County, and elsewhere in Texas, a driver suspected of having a blood alcohol content (BAC) of 0.08% or higher can be arrested for driving while intoxicated.  BAC is a measurement of the amount of alcohol in your bloodstream.

Many things influence whether you are over the legal limit. The strength of your drinks, the time since you drank them, and your sex, height, and weight all play a part.

In Copperas Cove, the penalties vary based on how many offenses you have had.

1st Offense

  • As high as a $2,000 fine
  • Three days mandatory minimum in jail, as much as six months
  • Suspension of your license for up to a year

2nd Offense

  • As high as a $4,000 fine
  • one to twelve months in jail
  • Suspension of your license for up to two years

3rd Offense

  • $10,000 fine
  • Two to ten years in prison
  • Suspension of your license for up to two years

Sentencing enhancements for driving while intoxicated with a minor passenger can include:

  • Increased fine, up to $10,000
  • As many as years in jail
  • 180 more days of driver's license suspension

You must pull over immediately and safely. Never flee from the police, because you will only make your situation worse.

When the officer walks up to your car, roll your window down and show your hands plainly. When they ask for your documents, ask if you can reach for them, and do it without any aggressive movements.

The officer will likely ask you if you know why you were pulled over. Just tell them "No Sir" or "No Ma'am". They are looking to establish probable cause for the stop. Don't help them build a case against you.

You can refuse the tests they ask you to take, as it's within your rights to refuse.  If you think you might fail the test, it's a good idea to refuse it anyway. Just tell the officer you aren't comfortable taking the test until you speak with your attorney.

If they think they notice slurred speech, alcohol smell, or bloodshot eyes, they might arrest you anyway. They will likely ask you to take a blood or breath test to establish your level of intoxication.  Refusal means that you will be subject to a license suspension.  If you fail the test you will lose your DL anyway. A lawyer can help you either way.

You can be ordered to allow a blood test after they get a warrant, but it takes time to contact the judge.

Never speak to the police and incriminate yourself. Always ask to speak with your lawyer at the first opportunity.

Never accept a guilty plea for DUI.  Whether it's your first or third DWI, putting up a vigorous defense is always in your best interests.
