Arrested for Driving While Intoxicated in Conroe?

Being arrested for a DWI is stressful and scary. You need to find help, fast.

Driving while intoxicated, or DWI, is a type of criminal offense where individuals drive a vehicle with a blood alcohol content, or BAC, above the legal limit. It is one of the more frequently committed crimes around Conroe.

Unfortunately, the government of Texas and the Montgomery County court system are not on your side when it comes to DWI violations. That's why you need a highly skilled and dedicated attorney to help you fight and hopefully beat these charges.

A DWI Is Costly and Stressful

People might assume because DWI is so frequent in Conroe that the price you pay if you are convicted isn't steep.

Guess again.

Here are the potential penalties for DWI convictions in Montgomery County:

First Offense:

  • As high as a $2000 fine
  • Between 3 days and six months in jail
  • Losing your driver's license for a year

Second Offense:

  • As high as a $2000 fine
  • Between 1 and 12 months in jail
  • Losing your driving privileges for 2 years

Third+ Offense:

  • As high as a $10,000 fine
  • Between 2 and 10 years in prison
  • Losing your driving privileges for 2 years

Child endangerment and DWI manslaughter are just a couple of the possible enhancement crimes that increase the sentences prosecutors will seek.

One Error Can Cost So Much If You Lose

In addition to the criminal penalties, a DWI can cause a number of serious negative consequences that can affect anyone, from insurance hikes to home rental background checks.

Finding the right lawyer is important, in large part because of the serious nature of a DWI charge.

If you were recently faced with a DWI, you definitely need to hire an experienced, qualified lawyer for yourself. It's going to be the best thing for you, and you're going to feel much better about the entire situation once everything is said and done.

About Michael & Associates

The one thing that seperates Michael & Associates is the white-glove treatment. We strive to give our clients the best result possible

The other lawyers out there will promise clients everything, then fail to deliver. That's not how we do things. We see clients as unique opportunities to help someone in need. We love what we do, and what we do is helping people who need it most.

At Michael & Associates, we reduce the number of cases we accept so that we can devote the time needed to each client.

As a client, you receive Ben Michael's personal cell number, and you are able to text him anytime morning or night.  At the larger firms you will get the answering machine and if they bother checking it that day you might get a call back by this time next week. You deserve more than that.

Our legal team, including Ben himself, will make sure you understand the process. Every step of the way, we explain the reason we are doing what we do. We ask that you are an active part of the process, and we think participation helps reduce the stress you are under.

Driving While Intoxicated in Conroe

In Conroe, Montgomery County, and the rest of Texas, drivers who are stopped by police with a (BAC) of 0.08% or higher might be charged with driving while intoxicated.  That is a measure of how much of your blood contains alcohol.

The number of beverages that put you at or above a BAC of 0.08% is dependent on several things, including the type of drinks, the time elapsed, your sex, weight, and the tolerance level of your body.

In Conroe, the sentences vary depending on your prior record.

1st Offense

  • As many as a $2,000 fine
  • As many as six months upon conviction, with three days that are mandatory
  • Losing your driver's license for up to a year

2nd Offense

  • As many as a $4,000 fine
  • As many as 1 month to a year in jail
  • Losing your driver's license for up to two years

3rd Offense

  • A $10,000 fine
  • As many as 2 to 10 years in prison
  • Losing your driver's license up to two years

An increase in sentences can be imposed if stopped with an underage passenger, which includes:

  • Additional fines up to $10,000
  • As many as two years in jail
  • Losing your driver's license for an increase of six months

Make it easier on yourself and pull over immediately when you are stopped. Running from the officers will only make the penalties worse for you.

Be sure to let the officer know where you are reaching when they ask you to get your paperwork. Never act aggressively toward an officer. Remember that you are probably being filmed by their bodycam.

Police will ask you if you are aware of why they pulled you over in the first place.  Always reply "No Sir" or "No Ma'am".  Once the case gets to court, any other answer besides no can be spun as probable cause to stop you, and your defense gets much harder.

You have the right to decline the roadside tests and maybe even should if you think you are going to fail them anyway. Be sure to let the officer know that you aren't comfortable taking the tests without speaking to your lawyer first.

If the officer suspects you have alcohol on your breath, or red eyes they might arrest you anyway. Same thing if you are slurring your speech when talking.  If you are arrested you might be required to take a blood or breath test to establish BAC.  If you still refuse at this time, you will face an automatic suspension of your license. That said, it will be suspended if you are convicted, and your lawyer can help you out in any case.

You might be forced to take the blood test at a hospital or in jail, but that warrant takes time to get.

Be sure to ask to speak with your lawyer at the earliest opportunity, and never say anything that can incriminate you.

Never accept a simple guilty plea for a DWI. The price for the plea is too high, and you are better off finding a lawyer who can help you negotiate a better outcome.
