About Michael & Associates

The difference is that we fight for our clients, and don't look at them as a case to be wrapped up as swiftly as possible.

Other firms, the larger firms, will offer you reduced rates while overpromising and underdelivering. We know the type. They churn through cases as fast as possible and aren't there for you when you need them most. That's not who you want on your side.

We look at our clients and see a person who needs our help. A person who needs the best legal representation possible. It's part of why we do this, and Ben's core value.

At Michael & Associates, we take on a low number of cases and treat each one with the care required to give you the best chance possible.

We will be sure to give you Ben Michael's personal cell phone number, and you can text him anytime - morning or evening.  With other firms, you would be lucky to get a call back at all, forget a pipeline directly to your lawyer at any time.

Michael & Associates is experienced in a wide range of criminal cases, we specialize in:

  • DUI / DWI
  • Possession of a Controlled Substance
  • Assault & Battery
  • Family Violence
  • Domestic Abuse

Cases we don't work on:

  • Traffic Law
  • Family Law
  • Immigration Law
  • Civil Law

We accept clients from anywhere in Texas.  From Austin to San Antonio, to everywhere in between, we work for you.

Driving While Intoxicated in Cedar Park

In Cedar Park, Williamson County, and anywhere else in Texas, a driver with a blood alcohol content (BAC) of 0.08% or higher risks arrest for DWI/DUI.  That number represents the amount of alcohol in your bloodstream at the time of the test.

Whether you are over the legal limit depends on several things. Your height, weight, and sex, as well as your tolerance and the amount of time that has passed since your last drink.

In Cedar Park, and anywhere else in Texas, penalties will depend on previous arrests.

1st Offense

  • As much as a $2,000 fine
  • As much as 6 months in jail, with three days being mandatory
  • Losing your license for a year

2nd Offense

  • As much as a $4,000 fine
  • Between 30 and 365 days in jail
  • Losing your license for as much as two  years

3rd Offense

  • $10,000 fine
  • 2 to 10 years in prison
  • Losing your license for as much as two  years

Sentencing enhancement guidelines will apply if driving with underage passengers:

  • Increased fines - up to $10,000
  • as much as two years in jail
  • Increased period of driver's license suspension

It's important to be respectful when you are pulled over. For starters, never run. It only makes things worse.

Roll your window down, and when asked to retrieve your documents do so slowly and without aggression. It's important to remain calm and respectful.

When the officer asks if you know why you were stopped, politely reply that you don't know. They are looking for probable cause and will use the reply against you in court. It removes a potential avenue of defense if you admit to an infraction.

It's within your rights to refuse the testing the officers ask you to undergo. It's probably a good idea to refuse any test you are going to fail anyway.  Just say you prefer to speak with your attorney before undergoing any testing and remain calm and respectful. You are possibly being recorded.

You could be arrested anyway on suspicion of DWI. If you are arrested, you will be asked to take a breathalyzer and perhaps a blood test.  Refusal means an automatic license suspension. You will lose your license anyway if convicted, so it might be best to let your lawyer fight this for you.

The officers can get a warrant to force you to participate in a blood test, but the warrant will take some time to get.

Never speak to an officer without an attorney present, and request a call to your lawyer at the earliest chance you are given.

Never accept the penalties of DWI without putting up a strong defense. The stakes are too high for you to simply plead guilty. Let your lawyers help make the process as painless as possible.
