Driving While Intoxicated in Boerne

In Boerne, Bexar County, and throughout Texas, any driver caught with a blood alcohol content (BAC) of 0.08% or higher can be arrested for driving while intoxicated.  The number measures what percentage of your bloodstream contains alcohol in it.

Having a BAC at or above 0.08% will depend on a few things, including how strong your drinks were, the time passed since you had them, as well as your height, weight, and sex.

In Boerne, the punishments will increase depending on whether you had prior convictions.

1st Offense

  • Six months of driver's license suspension added to the sentence

The most important thing to remember is never to run from an officer. It sounds obvious, but some people panic, and it's a huge mistake. The penalties for running from an officer are incredibly severe. 

After you stop the officer will ask you for your license and registration. Be sure to tell them where the documents are before reaching for them, and then retrieve them slowly. 

You will, of course, be asked if you know what led to the stop.  Always say "No Sir" or "No Ma'am".  The officer wants to establish probable cause for the stop, and it's vital that you say no so you preserve this avenue of defense for your legal team.

It's well within your constitutional rights to decline any test the officers want you to perform. If it is at all possible that you will fail those tests, declining is in your best interests.  Respectfully tell the officer that you want to speak with an attorney before undergoing any tests. Remember that you are probably on a bodycam, so be polite, and never act with aggression toward an officer. 

If officers think they see or hear slurred speech, alcohol smell, or bloodshot eyes, they might arrest you for suspicion of DWI.  They will ask you to take further tests. If you refuse you will lose your license for up to a year, but that is going to happen anyway if you are convicted.

They might call a judge to get a warrant to draw blood, but that takes some extra time.

Never incriminate yourself during questioning, and ask to speak with your lawyer at the earliest opportunity.
