Driving While Intoxicated in Beaumont

Bars are filled with armchair lawmakers who think that you can drink x amount of beers or shots and drive just fine. It might feel that way when they do it either because of the buzz or due to their higher alcohol tolerance, but each person is different and there's no one-size-fits-all solution. There are a few things you'll need to remember when being pulled over. The two big ones are:

  • Remember that you have the right to remain silent. Don't tell the police anything unless it's 100% necessary for your safety as it can hurt you in court. Wait for your lawyer to advise you.
  • Be polite and courteous. Whether you are over the legal limit or not, DWIs exist to keep you and others safe. Being polite will help you with the officer you deal with and especially in court in case you've been filmed.

When it comes to actually being pulled over, simply go to the side of the road or somewhere else out of the way in a prompt yet safe manner. Wait for the officer to come to your window and request your license, registration, and proof of insurance. Before grabbing them in a calm, slow manner, inform the officer of where the documents are in your car.

If you are asked to perform a field sobriety test or a breathalyzer, you may reject them. This is the best course of action if you suspect you may be too drunk to pass. Instead, let the officer know you'd prefer to wait for your lawyer before taking any tests.

Smelling like alcohol, slurring your speech, or showing any other obvious signs of intoxication will likely get you arrested and taken to the station where you'll be offered either a breathalyzer or a blood test. This is where the situation gets more difficult as you can refuse these tests, too, and wait for your lawyer, but it might lead to your license being suspended. Of course, failing the test leads to that outcome, too.

Lastly, if the police are feeling persistent that night, they might take the time to get a warrant approved to compel you to take a test. At this point, you need to comply and deal with the results as they come in.
